# BUILD OVER AGREEMENT

Parties: Harriet Moore and Westshire Water plc
## 1. Purpose and parties
Harriet Moore owns 18 Rowan Close, York, and Westshire Water plc is the sewerage undertaker. Harriet wants a 3.2 metre rear extension shown on architect Daniel Price's drawing DP-184, dated 18 July 2031, above a 225 mm public sewer running 1.1 metres from the existing wall.
## 2. Facts, scope and terms
Westshire consents to the build-over subject to a £1,850 administration and inspection fee, a pre-start CCTV survey, and a reinforced raft designed by engineer Priya Shah. No piling, basement, manhole covering or alteration of the sewer is permitted under this consent.
## 3. Process and responsibilities
Harriet will obtain planning and building-regulations approvals, give 15 working days' notice before excavation, keep the sewer accessible, and use a contractor with public-liability insurance of at least £5 million. Westshire may inspect and may stop work presenting an immediate risk to the sewer.
## 4. Evidence, records and safeguards
The parties will retain the signed plan, CCTV report, structural calculations, photographs and completion certificate. Harriet must protect workers and neighbours, divert surface water lawfully, and promptly report damage; Westshire will identify records it reasonably needs and avoid unnecessary access to the home.
## 5. Review, escalation and outcome
Westshire will issue a completion confirmation after a satisfactory final inspection. If the extension changes, an obstruction is found or the sewer condition is unsafe, the parties will meet within ten days; unresolved technical issues may go to an independent drainage engineer before court proceedings.
## 6. Reservations and practical protections
This consent does not transfer ownership of the sewer, guarantee planning permission or excuse statutory nuisance, negligence or building-control duties. Harriet remains responsible for contractors and for reasonable emergency access, while Westshire remains responsible for its own negligent inspection.
## 7. England and Wales law and completion
This fictional agreement is governed by England and Wales law and was signed on 4 August 2031. Notices may be posted or emailed to the stated parties, and each party keeps the fee receipt, approved drawing and signed counterpart.
