# CARE ACT ASSESSMENT APPEAL LETTER

## 1. Decision and addressee
Dear Ms Morgan, I request a review of South Wessex Council's Care Act assessment dated 8 November 2024 and the decision letter dated 15 November 2024, which recorded that I did not have eligible needs and offered no care and support plan. I am 67 and live alone at 18 Orchard Close, Dorchester. The decision concerns my current daily support; it is not a request to diagnose me or to treat my Parkinson's diagnosis as proof of incapacity.
## 2. Chronology and needs
On 12 September 2024 I told assessor Helen Wood that freezing episodes now prevent me from showering safely without someone nearby, and that tremor and fatigue mean I miss meals unless food is prepared. On 25 October my occupational therapist observed two falls in the bathroom and recommended a level-access shower and morning support. The assessment records 'independent with prompting' but does not explain how the fluctuating episodes or the effect on wellbeing were weighed.
## 3. Legal and procedural basis
Please reconsider the assessment under the Care Act 2014 assessment and eligibility framework and the current Care and Support Statutory Guidance. My request is that each relevant outcome and the impact on my wellbeing be addressed with evidence, rather than a budget-led conclusion. I can make this decision and give instructions: my Parkinson's diagnosis does not itself establish lack of mental capacity. Please confirm the Council's current review, complaints, and advocacy arrangements; routes and deadlines can change, so I will follow the prescribed form or current rules.
## 4. Requested outcome and evidence
I request a fresh assessment by a senior practitioner, a written eligibility analysis, and, if eligible needs are found, a care and support plan that considers morning personal care, meal preparation, falls prevention, and equipment. Pending review, please consider interim steps to manage immediate safety, without assuming that a particular service or outcome is guaranteed. I enclose the 15 November decision, the occupational therapist letter of 25 October, my falls diary for 1 October to 30 November, and my medication list. Please acknowledge by 10 December 2024 and give the review decision or a timetable by 7 January 2025.
## 5. Status and signature
I ask that correspondence be sent in accessible print and that you tell me how to obtain an independent advocate if required. This is an administrative review request, not a claim that judicial review or an Ombudsman investigation has already begun; I will check the current Council and Local Government and Social Care Ombudsman routes if unresolved.
