# COMPULSORY PURCHASE OBJECTION

Date: 14 October 2031

Parties: Ruth Evans and Westborough Council

## 1. Purpose and parties

Ruth Evans objects to Westborough Council's proposed West Link Compulsory Purchase Order affecting her freehold workshop and the access to 4 Mill Yard. She is the registered proprietor and occupier, and this objection is made before confirmation; it is not a refusal to engage with a lawful scheme.

## 2. Facts, scope and terms

The Council's statement of reasons says the road is needed for congestion relief. Ruth challenges the compelling-public-interest case because the preferred alignment has not compared a viable eastern route, would sever a functioning business, and has not demonstrated that funding and delivery are realistic.

## 3. Process and responsibilities

Her grounds include inadequate consideration of alternatives, disproportionate interference with property and business rights, unsafe construction access, noise and air-quality impacts, and failure to explain mitigation. She asks the acquiring authority to amend the order, protect access, or withdraw it where the statutory tests are not met.

## 4. Evidence, records and safeguards

The evidence bundle contains the title register, lease and business accounts, traffic survey, independent valuation, photographs, delivery schedules, planning representations and an accessibility plan. Ruth will update loss evidence and distinguish compensation for land, disturbance, severance and injurious affection from the merits objection.

## 5. Review, escalation and outcome

She requests confirmation of the objection deadline, the acquiring authority's statement and the likely public inquiry or written-representation process. If objections remain, the Secretary of State or inspector may hold an inquiry; Ruth may appear, call evidence and cross-examine where the procedure allows, and the order is not effective merely because it was made.

## 6. Reservations and practical protections

Ruth will continue to permit ordinary emergency access but will not sign a transfer, possession agreement or compensation settlement without advice. She asks for reasonable adjustments at the inquiry and reserves statutory compensation, human-rights and judicial-review arguments where available.

## 7. England and Wales law and completion

England and Wales compulsory-purchase law applies. This objection is dated 14 October 2031 and served by post and email as separate permitted methods on the Council's stated addresses, with proof of delivery and a request for written acknowledgement.
