# FAMILY COURT CONSENT ORDER

Date: 23 September 2031

Parties: Emily Carter and Michael Carter

## 1. Purpose and parties

Emily Carter and Michael Carter separated on 6 January 2031 after twelve years of marriage. They ask the Family Court at Leeds to approve their agreed financial order. They have one child, Oscar, aged 9, and a separate child-arrangements plan keeps Oscar's welfare outside the financial bargain.

## 2. Facts, scope and terms

The family home at 16 Willowbank Road is valued at £410,000 with a £176,000 mortgage. Michael will transfer his interest to Emily, who will refinance by 31 January 2032 and pay Michael £82,000; if refinancing fails, the house will be sold and net equity divided after the mortgage and sale costs.

## 3. Process and responsibilities

Emily retains her NHS pension and Michael retains his Aviva pension, with no pension-sharing order. Each keeps assets disclosed in Form E, including Emily's £18,400 savings and Michael's £11,250 ISA; each remains liable for debts in their own name except the joint mortgage until completion.

## 4. Evidence, records and safeguards

The parties exchanged Form E schedules, six months of statements, pension valuations, mortgage redemption figures and a schedule of school and childcare costs. They confirm that neither has hidden a material asset and agree to notify the other of a substantial disclosure error before the order is sealed.

## 5. Review, escalation and outcome

On completion of the transfer and £82,000 payment, the order provides a clean break in capital, income and pension claims, subject to Oscar's lawful child-maintenance needs. The court may refuse or amend the proposed order; the parties will not represent it as effective until approved and sealed.

## 6. Reservations and practical protections

Each obtained independent legal advice, understands that pensions and tax can have consequences, and will not pressure the other to sign. Emily will protect Oscar's housing and Michael may request a reasonable completion extension if a lender delay is documented; neither extension changes the agreed safeguards.

## 7. England and Wales law and completion

This completed fictional statement is dated 23 September 2031 for the Family Court of England and Wales. It is not a sealed order, but is signed by both parties with the consent application, financial disclosure and evidence of service retained.
