# DAMP AND MOULD COMPLAINT LETTER

Date: 18 March 2025

Parties: From: Aisha Khan, tenant, Flat 2, 15 Oak Street, Bristol BS3 4QJ. To: Martin Ellis, landlord, 8 Cedar Road, Bristol BS7 1LA.

## 1. Subject and tenancy

Subject: urgent complaint about damp and mould at Flat 2, 15 Oak Street. I occupy the flat under the assured shorthold tenancy dated 1 September 2023, tenancy reference OE-15-02, at £1,150 per month. I have paid rent to 31 March 2025 and am not withholding rent.

## 2. Chronology and impact

Mould appeared on the bedroom external wall and bathroom ceiling in November 2024. I reported it by email on 2 December 2024 and again on 20 January 2025. The bathroom extractor remains broken, paint is flaking, and clothes and a mattress have been affected. My GP recorded a cough and advised reducing exposure; that record does not by itself establish causation.

## 3. Basis of complaint

Please treat this as notice of defects and a request to comply with the repairing obligations that apply to the structure, exterior and installations. The Homes (Fitness for Human Habitation) Act 2018 and Landlord and Tenant Act 1985 may be relevant, including any damp or mould hazard assessed under the current housing standards. I do not assert a final legal conclusion before inspection.

## 4. Requested action and deadline

Please acknowledge by 25 March 2025, arrange a qualified inspection by 1 April 2025, and give me a written remediation plan by 8 April 2025. It should identify the source, repair the extractor and building defects, safely remove mould, and prevent recurrence. Please propose access times rather than entering without the required notice.

## 5. Evidence, escalation and status

Enclosed are photographs dated 16 March 2025, the two reporting emails, the tenancy schedule, and a GP note. If there is no adequate response, I may contact Bristol City Council Environmental Health and seek independent advice; any court or ombudsman route and current prescribed procedure must be checked first.
