# DEED OF EASEMENT

Parties: Amelia Hart and Rowan Field Developments Ltd

## 1. Purpose and parties

This deed is made on 21 May 2034 between Amelia Hart of 7 Orchard Close, Ely CB7 4QH (the Grantor) and Rowan Field Developments Ltd of 40 Market Street, Ely CB7 4LP (the Grantee). The Grantor owns Willow Cottage and the Grantee owns Rowan Yard, identified by the plans attached to this deed.

## 2. Facts, scope and terms

The Grantor grants to the Grantee, for the benefit of Rowan Yard, a right to pass and repass on foot and with private cars over the blue access strip on plan 1, and a right to lay, inspect, maintain and replace private electricity and water conduits in the green service route on plan 2. The rights are limited to access to Rowan Yard and its lawful use.

## 3. Process and responsibilities

Vehicles must not exceed 3.5 tonnes and must travel at a reasonable speed. The Grantee must keep gates closed, avoid unreasonable obstruction and cause as little damage as reasonably practicable. Construction traffic requires seven days' written notice and must comply with any reasonable route or timing arrangements agreed with the Grantor.

## 4. Evidence, records and safeguards

The Grantee will pay all costs of constructing and maintaining the conduits and will repair damage caused by its exercise of the rights. For routine shared resurfacing, the Grantee pays 70% and the Grantor 30%, with an estimate supplied before non-urgent work. Emergency work needed to prevent immediate danger may be done first, with notice as soon as practicable.

## 5. Review, escalation and outcome

The rights are granted in perpetuity, subject to this deed, and bind successors to the extent the rights and burden are registrable and take effect at law. They do not grant parking, storage, access for unrelated land or permission to enter buildings. The parties will cooperate with Land Registry applications and sign reasonable documents needed to register the deed.

## 6. Reservations and practical protections

The parties will give written notice of a breach and allow 20 working days to remedy it, except for urgent safety risk. Nothing prevents an injunction, damages or another remedy available at law. The Grantee must maintain public liability insurance appropriate to its works, but insurance does not limit liability for negligent damage.

## 7. England and Wales law and completion

This completed fictional deed is governed by the law of England and Wales. It is intended for execution as a deed, with each individual signing in the presence of a witness and the company executing in a legally valid manner; delivery and registration requirements must be satisfied. The parties should obtain conveyancing advice before relying on this worked example.
