# DRIVING DISQUALIFICATION APPEAL LETTER

## 1. Sentence appealed
On 4 March 2025 the magistrates' court convicted me of speeding at 56 mph in a 40 mph limit, an endorsable offence carrying three points. With nine other live points, I had 12 live points in total, and the court imposed a six-month totting-up disqualification under section 35 of the Road Traffic Offenders Act 1988. The order takes effect from 4 March 2025. I accept the conviction and do not ask this letter to revisit guilt; I appeal the disqualification decision on exceptional-hardship grounds.
## 2. Hardship relied on
I am a field service engineer employed by West Trent Water Services Ltd, earning £34,800 gross a year. My contract requires visits to rural sites across Lincolnshire; the employer confirms that no practicable non-driving redeployment exists and dismissal is likely after four weeks without a licence. My partner is recovering from surgery and I take her to scheduled treatment, but I do not claim that this alone proves exceptional hardship.
## 3. Proposed evidence and legal caution
I enclose the employer letter, contract, six recent payslips, route map, treatment appointments and household budget. I understand that hardship to the ordinary offender is not enough and that the court must apply the current statutory test; I ask the Crown Court to assess the particular consequences evidenced here. I do not assert that an appeal will succeed.
## 4. Order sought and interim position
I ask the Crown Court to allow the appeal or vary the disqualification only as the law permits, and to consider any properly made application concerning suspension pending appeal. I will not drive while disqualified unless a court order expressly permits it. Any application must use the current form and rules and be made within the applicable deadline.

I ask the magistrates' court to record this notice and provide the current filing directions. The statutory time limit and destination must be verified immediately; this supporting letter is not a substitute for the prescribed appeal notice. Copies go to the prosecutor where required.
