# EXAMPLE: DEED OF EASEMENT AGREEMENT

Parties: Alice Warren and Rowan Developments Limited
## 1. Parties and property
This deed is made on 24 May 2029 by Alice Warren of 6 Orchard Rise, Bath BA2 3CD (owner of the dominant land, title ST12345) in favour of Rowan Developments Limited (owner of the servient land, title ST67890). The coloured route on Plan A is incorporated into this deed.
## 2. Consideration and rights
The owner of the dominant land is granted a right of way on foot and with private cars over the 3-metre access track marked A to B, at all times and for access to 6 Orchard Rise only. The right is for the benefit of the land, not a personal parking or storage right.
## 3. Conditions and covenants
Alice pays Rowan £18,000 on completion. Rowan must keep the track reasonably passable; Alice must contribute 35% of agreed maintenance and resurfacing costs, not including damage caused by Rowan's construction traffic, with 14 days' notice of works.
## 4. Management and liability
Neither owner may obstruct the route, narrow it or use it for a different purpose. Emergency services retain their legal access, and any gate must remain unlocked or provide a key-safe code. Construction, utility and planning consents remain each owner's responsibility.
## 5. Registration and tax
The right is subject to title restrictions, mortgages, superior rights and any consent required by a lender or the Land Registry. The parties will apply to register the easement against both titles, and the deed does not guarantee registration or priority.
## 6. Term and effect
Disputes about maintenance go first to a jointly appointed surveyor; legal rights to injunction or damages remain. The parties will notify successors and disclose this deed on any sale, but personal assurances do not replace a registrable disposition.
## 7. Execution as a deed
Alice executes this deed in the presence of an independent witness; Rowan executes by two authorised signatories or director and witness. Each intends delivery on the date above.
