EMPLOYMENT AGREEMENT

This Agreement is made between Bright Harbour Design Pty Ltd of 120 Collins Street, Melbourne VIC 3000 and Sofia Nguyen of 9 Lygon Terrace, Carlton VIC 3053.

1. Appointment

The Employer employs the Employee as Senior Product Designer from 5 October 2026. Continuous employment begins on 5 October 2026. The Employee will report to the Head of Product.

2. Duties and place of work

The Employee will perform the duties in the attached role description and other reasonable duties consistent with the position. The normal place of work is the Melbourne office, with up to two agreed remote-working days per week.

3. Hours

Normal hours are 38 hours per week on Monday to Friday, with reasonable additional hours where lawful and necessary. Breaks, overtime and maximum working time remain subject to applicable law.

4. Pay

The Employer will pay AUD 118,000 per year plus mandatory retirement contributions monthly, subject to lawful deductions. Pay will be reviewed annually, but a review does not guarantee an increase.

5. Leave and benefits

The Employee is entitled to paid annual leave, public holidays, sickness rights, family leave, pension or retirement contributions and other minimum entitlements required by law. Additional benefits are five additional paid personal wellbeing days and approved professional-development expenses.

6. Confidentiality

The Employee must protect the Employer's confidential information during and after employment and use it only for authorised work. This does not prevent protected disclosures or the exercise of legal rights.

7. Intellectual property

To the extent permitted by law, intellectual property created in the course of employment and within the Employee's duties belongs to the Employer. The Employee will sign reasonable documents to confirm ownership.

8. Policies

The Employee must follow lawful workplace policies. Non-contractual policies may be updated after appropriate notice and consultation.

9. Termination

Either party may terminate employment by giving four weeks' written notice, subject to statutory minimum notice and protections. The Employer may make payment in lieu where lawful.

10. Governing law

This Agreement is governed by the employment law of Victoria, Australia. Mandatory employee protections continue to apply.

11. Probation and performance

The first six months are a probationary period, subject to applicable law. The Employer will provide reasonable induction, feedback and an opportunity to address performance concerns. Completion of probation does not remove either party's termination rights.

12. Expenses, equipment and remote work

The Employer will provide a laptop and approved software. Reasonable business expenses will be reimbursed when supported by receipts and submitted within 30 days. The Employee may work from home up to two days each week with manager approval and must maintain a safe, private workspace and comply with information-security requirements.

13. Conflicts and outside work

The Employee must disclose actual or potential conflicts and obtain written approval before undertaking paid work that competes with the Employer, materially interferes with duties or creates a confidentiality risk. Approval will not be unreasonably withheld for unrelated activities outside working hours.

14. Privacy and monitoring

The Employer may process employment information for payroll, benefits, safety, performance and legal compliance. Lawful and proportionate monitoring of Employer systems may occur after appropriate notice. The Employee must follow the privacy notice and acceptable-use policy.

15. Return of property and post-employment duties

On request or termination, the Employee must return Employer property and confidential material and provide current passwords and work records belonging to the Employer. Confidentiality, intellectual-property and accrued-rights provisions continue after termination.

Schedule 1 - Sample employment particulars

Employer: Bright Harbour Design Pty Ltd, 120 Collins Street, Melbourne VIC 3000.

Employee: Sofia Nguyen, 9 Lygon Terrace, Carlton VIC 3053.

Position: Senior Product Designer, reporting to the Head of Product.

Start date: 5 October 2026. Primary workplace: Melbourne office with agreed hybrid work.

Hours: 38 hours per week, ordinarily Monday to Friday, 9:00 am to 5:30 pm including meal breaks.

Salary: AUD 118,000 per year plus mandatory retirement contributions, paid monthly.

Leave: statutory minimum entitlements plus five additional paid personal wellbeing days each year.

Notice: four weeks by either party, subject to statutory rights and any greater entitlement.
