# FLOOD RISK DISCLOSURE NOTICE

Date: 22 September 2031

Parties: Imogen Clarke and Noah Williams

## 1. Purpose and parties

Imogen Clarke, the owner and proposed seller, gives Noah Williams this disclosure for 6 Mill Stream Gardens, York, YO10 3LF, title number NYK781204. The disclosure accompanies the sale information and is intended to ensure that Noah has the known flood facts before deciding whether to proceed; it is not a warranty that flooding will or will not occur.

## 2. Facts, scope and terms

The Environment Agency flood map checked on 7 September 2031 places the house in Flood Zone 3a, described as a high probability of river flooding of 1% or greater annually. The local search dated 10 September 2031 records the River Foss catchment, while the property itself is on a raised plot approximately 1.2 metres above the rear garden. Imogen has not treated the raised plot as removing the mapped risk.

## 3. Process and responsibilities

On 2 February 2021, the River Foss overtopped after 74 millimetres of rain in 24 hours. Approximately 280 millimetres of water entered the garage and 90 millimetres reached the tiled ground-floor hallway; no water entered the bedrooms. The incident damaged plaster, skirting boards and the garage door, and Imogen made an insurance claim of £18,640, which was settled on 16 June 2021 after drying and reinstatement.

## 4. Evidence, records and safeguards

The current insurer is North Counties Underwriting Limited. The policy renewed on 1 August 2031 at an annual premium of £2,480, with a flood excess of £5,000, and the insurer has confirmed cover subject to annual maintenance of the barriers. Imogen has not made another flood claim. The property was built in 2006 and the insurer has confirmed that it is eligible for Flood Re, although Noah must obtain his own quotation and confirm any lender requirements.

## 5. Review, escalation and outcome

The resilience work completed on 12 November 2021 included a 0.6-metre-rated flood door to the rear entrance, two removable kitchen barriers, four non-return valves on drainage points, raised ground-floor sockets at least 1 metre above floor level, flood-resistant plaster to the hallway and a tiled replacement floor. The barriers were inspected on 14 August 2031 and the inspection record recommends a further annual check before 14 August 2032.

## 6. Reservations and practical protections

Imogen registered 6 Mill Stream Gardens for Environment Agency flood warnings on 9 February 2021 and keeps the barrier instructions, invoices, photographs, claim settlement and policy schedule. Noah is advised to commission an independent flood risk assessment, ask the insurer about contents and alternative-accommodation limits, inspect the drainage and obtain his lender's written position on lending against a Zone 3a property. Imogen will give reasonable access for those investigations.

## 7. England and Wales law and completion

This completed fictional notice is dated 22 September 2031 and is governed by England and Wales law. It records Imogen's knowledge as at that date, including the 2 February 2021 event, but does not limit Noah's survey, insurance, contractual or statutory rights. Noah should sign an acknowledgement of receipt only, not an acceptance that the disclosures are complete, and both parties will retain the map, local search, insurance confirmation and mitigation records.
