# GYM MEMBERSHIP CANCELLATION LETTER

Date: 14 September 2031

Parties: Oliver Bennett and Riverside Fitness Club Ltd

## 1. Purpose and parties

Oliver Bennett of 6 St Anne's Crescent, Bristol, is member RF-77104 of Riverside Fitness Club Ltd under a rolling monthly membership that began on 10 January 2031. The agreed fee is £42.50 per month, collected by Direct Debit from account ending 1842 on the 10th of each month. This letter gives formal notice that Oliver cancels the membership and asks Riverside to stop supplying and billing the service.

## 2. Facts, scope and terms

On 2 September 2031 Oliver's GP, Dr Hannah Lewis, certified that a knee injury requires him to avoid gym exercise and weight-bearing training until 31 December 2031. The certificate and physiotherapy referral are enclosed. Oliver has not used the club since 28 August, and continued attendance is medically inappropriate rather than a decision to avoid a contractual minimum term.

## 3. Process and responsibilities

Riverside also closed the swimming pool from 1 August 2031 for unannounced works and removed six resistance machines on 20 August. Its email of 22 August said the pool would reopen on 30 September, but the membership brochure promised pool access, a resistance area and staffed hours from 06:00 to 22:00. The replacement equipment does not provide the advertised service, and Oliver does not consent to a material reduction being treated as acceptance.

## 4. Evidence, records and safeguards

Oliver requests immediate cancellation on medical grounds under clause 9.3 of the membership terms, alternatively cancellation for the significant change to facilities under the Consumer Rights Act 2015. Riverside must mark the account closed on 14 September 2031, stop access charges and instruct its Direct Debit provider not to collect the £42.50 due on 10 October 2031. Oliver will not cancel the Direct Debit before receiving written confirmation that no further collection is being presented.

## 5. Review, escalation and outcome

The supporting record consists of the membership agreement signed 10 January 2031, the payment schedule, Dr Lewis's certificate dated 2 September, the physiotherapy referral, the 22 August Riverside email, the brochure pages 3 and 7, and a photograph of the closed pool notice dated 1 August. Oliver asks for a final statement showing payments through 10 September and the unused period from 14 September to 9 October.

## 6. Reservations and practical protections

Because £42.50 has already been collected for the monthly period from 10 September to 9 October, Oliver requests a pro-rated refund of £36.83 for 26 unused days, calculated as £42.50 divided by 30 days multiplied by 26 days and rounded to the nearest penny, within 14 days. He will return any access fob by recorded post on 16 September, keep the delivery receipt and cooperate with a reasonable account check, while reserving his right to dispute any administration or early-termination fee.

## 7. England and Wales law and completion

This completed fictional letter is dated 14 September 2031 and is governed by the law of England and Wales. Riverside should confirm cancellation, the refund date and Direct Debit instruction by 28 September 2031. If it continues to bill, Oliver reserves a complaint to the club, his bank and any applicable ADR or court route; acceptance of a refund does not waive a claim for an unauthorised later payment or failure to provide the contracted service.
