# IMMIGRATION APPEAL LETTER

Date: 2 November 2029

Parties: Luca Marino and the First-tier Tribunal (Immigration and Asylum Chamber)

## 1. People, purpose and legal route

To the First-tier Tribunal (Immigration and Asylum Chamber): I, Luca Marino, appeal the Home Office refusal dated 18 October 2029 of my application for leave to remain as the partner of Sofia Grant. My Home Office reference is HO-771920 and my current address is 44 Kingfisher Road, Cambridge CB4 2HA.

## 2. Facts, scope and supporting evidence

The refusal says the financial requirement was not met because Sofia's self-employed income was excluded and says the relationship evidence was insufficient. I understand that a right of appeal must be checked against the decision notice; where the route is administrative review or reconsideration rather than an appeal, this letter must be adapted and sent to the correct decision-maker.

## 3. Requests, duties and safeguards

The financial ground is wrong: Sofia's SA302, tax year overview, business accounts and bank statements show gross income of £34,800 for the relevant period, above the applicable Appendix FM threshold. The decision appears not to have considered the enclosed evidence or invited clarification of a discrepancy.

## 4. Records, review and communication

Our relationship is genuine and subsisting. We have lived together in Cambridge since April 2025, share a tenancy and utilities, and have supplied photographs, messages, travel records and statements from family. Removal would interfere with our family life under Article 8 ECHR; proportionality and any applicable EX.1 or human-rights route must be assessed rather than assumed.

## 5. Time limits, escalation and outcome

I enclose the decision, application, refusal reasons, chronology, witness statements and indexed evidence bundle. I request permission to rely on translated documents and reserve the right to supplement evidence by the tribunal directions. I will notify the Tribunal of any change of address and comply with hearing directions.

## 6. Reservations and practical protections

I ask that the appeal be allowed, the decision be withdrawn or the matter be remitted as the Tribunal considers lawful. This is not a request to ignore immigration rules; it is a challenge to material errors. Appeal and administrative-review deadlines are strict, and this letter does not itself extend them; I have sought specialist immigration advice.
