# CARE HOME入居契約書（記入例）

## 1. 当事者と目的
Company No. 07651248、CQC registration 1-7654321098、10 Church Road, York YO24 1ABのWillowbank Care Home Ltdは、2029年1月15日からPeter James EvansをRoom 18に受け入れます。娘でproperty and financial affairsのdeputyであるLaura Evansがfinancial provisionに署名しますが、Peterのwishとdecision-making rightが中心です。
## 2. 対象・対価・範囲
roomはsingle occupancy、en-suite、call system、communal loungeとgardenへのaccessを備えます。週額1,185ポンドを毎週月曜前払いとし、accommodation、meal、laundry、通常のnursing support、activityを含みます。toiletry、hairdressing、chiropody、個別依頼のtransportはpublished rateで別料金です。
## 3. 実施上の義務
入居時assessmentのcare planに基づき、washing・dressing補助、diabetes monitoring、falls prevention、prescribed medication administrationを行います。WillowbankはMAR chart、care note、incident report、current risk assessmentを維持し、重大incidentまたはneedのmaterial changeをLauraへ速やかに通知します。
## 4. 法令・記録・管理
Peterにはdignity、privacy、family contact、advocacy、religious observance、decision参加のrightがあります。restrictionはMental Capacity Act 2005の下で必要・proportionateかつ記録された場合だけ許され、deprivation of libertyには適切なauthorisationが必要です。safeguarding concernはCare Act 2014とCQC requirementに従いreportします。
## 5. 期間・終了・救済
LauraはPeterの指定accountからfeeを支払います。local authorityまたはNHS Continuing Healthcareが一部fundする場合、当事者は正確なinformationを提供しassessed contributionだけを払います。homeはself-fundingをpermanent obligationとして誤表示しません。care need変更後はreasonable noticeを伴う6週間のfee reviewを行います。
## 6. 責任と留保
各当事者は28日前noticeでplacementを終了でき、lawful hospital discharge、alternative placement、serious riskならより早く終了できます。WillowbankはPeterとLauraにconsultし、medicationとrecordのtransfer、written statement of accountを用意します。non-paymentには裁判前にwritten arrears planを提案しますが、emergencyは除きます。
## 7. 準拠法と署名
イングランド法を適用し、CQC complaint、local-authority safeguarding、NHS process、Peterのstatutory rightを制限せずcourts of England and Walesが管轄します。Willowbankのmanager Helen Brooks、Peter、Lauraは、independent adviceの機会とaccessible copyを得て2029年1月15日に署名します。
