# WHEEL CLAMPING COMPLAINT LETTER（PRIVATE LANDのCLAMPING COMPLAINT）

## 1. 目的と当事者
Maya Collinsは、19 June 2031にLeedsのNorthgate Retail Parkで車をclampされ、release fee £350を支払った件をNorthgate Parking Enforcement Ltdへ申し立てます。これはpublic roadではなくprivate landであり、Northgateはlandownerのauthorised operatorだと述べています。
## 2. 事実、範囲および条件
entrance signはhedgeの後ろにあり、bay signは照明がありませんでした。Mayaは壊れたpayment machineのため、urgent prescriptionを受け取る5分の停車で車を戻すためunder protestで支払いました。noticeとamountの双方をdisputeします。
## 3. 手続と責任
private landのclampingは当然にunlawfulではありませんが、Northgateはclearでprominentなcontractual warningとlawful authorityを示す必要があります。MayaはProtection of Freedoms Act 2012上のbasis、keeper-liability notice、DVLA accessのproper authorisationを説明するよう求めます。public roadのprivate operatorによるclampingは別のcriminal issueになり得ます。
## 4. 証拠、記録および保護措置
当夜のphotograph、receipt、pharmacy evidence、vehicle log、signのsketchをencloseします。NorthgateはCCTV、operator note、payment record、landowner authorityをpreserveし、DVLA dataをlawful purpose以外でdiscloseすべきではありません。
## 5. review、escalationおよびoutcome
£350 refund、balanceのcancel、debt collectorをinstructしないwritten confirmation、DVLAまたはcredit record entryのcorrectionを求めます。rejectされた場合、operatorに応じてBPAならPOPLA、IPCならIASのappealを使い、必要ならDVLA、ICO、Trading Standardsへcomplainします。
## 6. 留保と実務上の保護
本complaintはcontractual liabilityをadmitしません。Mayaは28日以内のreasoned responseを求め、restitution、consumer protection、data misuseに関するclaimをreserveします。complaintの検討だけでappeal deadlineがextendされるわけではありません。
## 7. England and Walesの法と完了
本fictional letterにはEngland and Wales lawを適用し、Northgateへpostとemailを別個のpermitted service methodとして送ります。Mayaは3 July 2031にsignし、original receiptとcopyを保管します。
