# COMPULSORY PURCHASE OBJECTION（COMPULSORY PURCHASE OBJECTION）

## 1. 目的と当事者

Ruth Evansは、Westborough CouncilがproposeするWest Link Compulsory Purchase Orderがfreehold workshopと4 Mill Yardへのaccessに影響するためobjectします。Ruthはregistered proprietorかつoccupierで、confirmation前にobjectionを行います。lawful schemeへのengage拒否ではありません。

## 2. 事実、範囲および条件

Councilのstatement of reasonsはcongestion reliefのためroadが必要だとします。Ruthは、viable eastern routeとのcomparisonがなく、preferred alignmentがfunctioning businessをseverし、fundingとdeliveryのrealistic evidenceも示していないためcompelling-public-interest caseをchallengeします。

## 3. 手続と責任

groundにはalternativeのinadequate consideration、property・business rightへのdisproportionate interference、unsafe construction access、noise・air-quality impact、mitigation explanationのfailureを含めます。statutory testを満たさない範囲でorderをamend、accessをprotect、withdrawするよう求めます。

## 4. 証拠、記録および保護措置

bundleにはtitle register、lease、business account、traffic survey、independent valuation、photograph、delivery schedule、planning representation、accessibility planを含めます。loss evidenceをupdateし、land、disturbance、severance、injurious affectionのcompensationとmerits objectionを区別します。

## 5. review、escalationおよびoutcome

objection deadline、acquiring authorityのstatement、public inquiryまたはwritten-representation processをconfirmするよう求めます。objectionが残ればSecretary of Stateまたはinspectorがinquiryをholdし、procedureがpermitすればRuthはappear、evidenceをcall、cross-examineできます。orderはmadeだけでeffectiveになりません。

## 6. 留保と実務上の保護

Ruthはordinary emergency accessをpermitしますが、adviceなしにtransfer、possession agreement、compensation settlementへsignしません。inquiryでreasonable adjustmentを求め、availableなstatutory compensation、human-rights、judicial-review argumentをreserveします。

## 7. England and Walesの法と完了

England and Wales compulsory-purchase lawを適用します。本objectionは14 October 2031付で、Councilのstated addressへpostとemailを別個のpermitted methodとしてserveし、delivery proofとwritten acknowledgement requestを保管します。
