# LASTING POWER OF ATTORNEY FOR HEALTH AND WELFARE（HEALTH AND WELFARE LPA）

## 1. 目的と当事者
72歳でBristolに住むMargaret Ellisは、本health and welfareのlasting power of attorneyをmakeします。sonのDaniel EllisとfriendのNoor Patelをattorneyにjointly and severallyでappointし、どちらもactできる一方、互いにconsultしMargaretがparticipateできるときはinvolveするよう求めます。
## 2. 事実、範囲および条件
authorityはcare、living place、daily routine、healthcare、life-sustaining treatmentのdecisionをcoverしますが、attorneyがactできるのはstatutory conditionがpermitする場合だけです。Bristol近隣にremainしたいpreference、written advance statementとreligious wishをconsiderするinstructionをstateします。
## 3. 手続と責任
least restrictive optionを使い、professional viewをseekし、relevant informationをshareし、significant decisionをrecordするようinstructionします。vegetarian meal、familiar music、sister visitをpreferします。DanielとNoorはparticular treatmentをdemandせず、valid advance decisionをoverrideせず、自分のbenefitのためにactしません。
## 4. 証拠、記録および保護措置
prescribed LPA formにMargaretのdetail、attorney、replacement arrangement、certificate provider、witnessをrecordします。powerのnatureとeffectをunderstandし、pressure下でなく、sign時にcapacityがあるとconfirmします。attorneyはrequired witness formalityでsectionをsignしdutyをreadします。
## 5. review、escalationおよびoutcome
completed instrumentはattorneyがuseする前にOffice of the Public Guardianへregisterする必要があります。OPGはnamed personへnotifyし、そのprocessでobjectionを受けます。registrationは全future decisionがrightだとproveせず、attorneyはMental Capacity Act 2005のprincipleとsupervisionに従います。
## 6. 留保と実務上の保護
Margaretはcapacityがある間、prescribed processでLPAをrevokeしOPGへnotifyできます。LPAはproperty・financial decisionをauthoriseせず、clinicianへのautomatic instructionでもcare placementをguaranteeしません。deprivation of liberty、dispute、safeguardingはadviceを得るべきです。
## 7. England and Walesの法と完了
England and Wales lawを適用します。Margaretは27 June 2031、independent witnessの前でprescribed sequenceに従ってsignし、Daniel、Noor、certificate providerがsectionsをcompleteします。feeとcopyをsecureに保持し、Office of the Public Guardianへapplicationを送ります。
