# 医療過誤請求書簡（記入例）

## 1. 文書の性質
2028年2月8日のSouthmoor General Hospital treatmentについて、Pre-Action Protocol for the Resolution of Clinical Disputesに基づきSouthmoor NHS Trustとclaims handlerへopen Letter of Claimを送ります。腹痛で入院しsurgeryを受けました。
## 2. 当事者と対象
初期主張は、surgical teamが記録されたblood pressure低下に対応せず、悪化するpainとfeverを速やかに調査しなかったことです。約19時間後のCTでleakが判明し、second operationが必要になりました。
## 3. 事実と請求
sepsis、12日間critical-care入院、追加surgery、scarが生じました。今も疲労し、元のnursery roleをfull-timeでできずfollow-upが必要です。causationとprognosisはindependent expertの事項で、本書はmedical conclusionではありません。
## 4. 証拠と確認
colorectal surgeon、microbiologist、pain specialist、careまたはoccupational expertのreportを適切に取得します。暫定special damagesはlost earnings、travel、care、treatmentの18,460ポンドでscheduleに従い、general damagesとfuture lossはevidence後に留保します。
## 5. 手続と期限
records、audit trail、observation、drug chart、imaging、consent、incident report、staff rota、policyを保存してください。Trustのlegal identity、indemnity arrangement、accessible electronic formatでrecordsを提供できるか確認してください。
## 6. 権利と救済
14日以内にacknowledgeし、Protocol timetable内にadmission、denial、reasonsを示すLetter of Responseをください。limitationは合意も放棄もしておらず、court proceedings、expert evidence、NHS Resolution processには特定要件があると理解します。
## 7. 記録と署名
本書はfair investigationとsettlementを促すもので、Part 7 claimやfinal valuationではありません。interest、costs、contributory-negligence issueその他救済を留保します。consentとconfidentialityを守り、2029年7月4日に署名します。
