# モデル・画像利用許諾書（記入例）

## 1. 当事者と撮影・利用
6 Orchard Mews, Bristol BS5 8QTのTessa Brownは、Brightwater Homeware Ltd（Company No. 13048562）に、2029年7月18日のstudio sessionでphotograph、likeness、recorded voiceをcaptureするconsentを与えます。Tessaは成人で署名能力があると確認します。
## 2. 許諾する権利
TessaはBrightwaterへ、approved photographとshort video clipをwebsite、social media、online advertising、catalogue、UK point-of-sale materialでreproduce、edit、publish、communicate、distributeするnon-exclusive worldwide licenceを与えます。termはfirst publicationから3年間です。
## 3. 媒体・地域・期間
Brightwaterはcrop、colour-correct、retouch、textまたはproduct composite追加ができますが、materially defamatoryまたはmisleading depictionは作りません。Tessaにgeneral pre-publication approval rightはなく、political advertising、medical claim、adult contentにimageを使いません。
## 4. 編集・表示
feeはVATをproperly chargeできる場合を含め650ポンドで、session後14日以内にBACS支払です。Tessaは法的に適用される範囲でperformerとしてidentifyされるrightをassertしますが、campaign formatが許さなければcredit omissionに同意します。CDPA 1988のmoral-rights waiverはnarrowに記録します。
## 5. 対価とデータ
Brightwaterはcampaign managementのimage・contact dataについてcontrollerであり、working fileをlicence term＋legal・accounting purposeの3年間保持します。access controlを適用し、Tessaへprivacy informationとUK GDPR rights noticeを渡します。本releaseは無関係なprocessingへのblanket consentではありません。
## 6. 撤回と責任
Tessaはwritten noticeで将来のvoluntary useについてconsentをwithdrawできますが、既にlawfully print・publishされたmaterialのrecallや合意termのcontractual licenceをundoしません。Brightwaterは自らのnegligence・unlawful useに責任を負い、Tessaはconflicting releaseがないとwarrantします。
## 7. 同意と署名
イングランド法を適用し、courts of England and Walesがjurisdictionを持ちます。TessaとBrightwaterのauthorised producer Maya Chenが2029年7月18日に署名します。minor・guardian consentは関係せず、materially異なるcampaign、product、useには新たなwritten releaseが必要です。
