# NOISE NUISANCE COMPLAINT LETTER（NOISE NUISANCE）

## 1. 目的と当事者
私は12 Cedar Mews, Guildford GU2 8RAのHannah Coleです。自宅隣10 Market Streetのcommercial unitからpersistent amplified bassとlate-night deliveryがあり、council Environmental Health teamにinvestigationを求めます。
## 2. 事実、範囲および条件
incidentは4 January 23:15〜00:40、5 January 22:50〜01:05、6 January 23:30〜00:20です。windowをcloseしてもbedroomでbassが聞こえsleepがinterruptされました。contemporaneous logにtime、duration、weather、description、operatorへのcontactをrecordします。
## 3. 手続と責任
20 Decemberにoperatorへpolite written request、2 Januaryにmanagerとconversationをしましたがnoiseは継続しました。一つのunpleasant eventをproofと扱わず、frequency、duration、character、neighbourhood contextをevidence-ledにassessしてください。
## 4. 証拠、記録および保護措置
complaintをacknowledgeし、investigation processを説明し、officer visit、monitoring equipment、operatorとのcontactをconsiderしてください。recording、log、witness detail、appointmentによるaccessをprovideできますが、recordingだけでstatutory nuisanceをestablishしないと理解します。
## 5. review、escalationおよびoutcome
Environmental Protection Act 1990 Part IIIのstatutory nuisanceと考えればabatement noticeをconsiderしてください。councilはstatutory judgementをexerciseし、noticeはappealされ得ます。confrontationを避け、immediate dangerだけemergency serviceを使います。
## 6. 留保と実務上の保護
personal dataをprotectし、case reference、review・complaint routeを教えてください。private nuisanceその他rightをreserveしますが、本letterでlegal findingはしません。operatorはown evidenceとcontrolを提案できます。
## 7. England and Walesの法と完了
England and Wales lawを適用します。complaintは2031年1月7日にemailとpostを別個の許可methodとして送ります。Hannah Coleがsignしreceipt confirmationを求めます。
