# POSTNUPTIAL AGREEMENT（POSTNUPTIAL契約）

## 1. 当事者、目的およびlegal route
21 Church Walk, Bath BA2 3JLのRachel EvansとMichael Evansはmarried spousesです。immediate separationを想定するのではなく、financial review後に本postnuptial agreementを締結し、propertyとliabilityをorganiseする現在のintentionを記録します。
## 2. 事実、scopeおよびsupporting evidence
Rachelのmarriage前propertyである4 Queens Road, Bristol（value £310,000、mortgage £118,000）は彼女のseparate propertyです。MichaelのEvans Joinery Limited 25% interestとISA £42,000は彼のseparate assetです。21 Church Walkのfamily homeはjointly heldで、mortgageとequityはequal shareを意図します。
## 3. request、義務およびsafeguard
各spouseはSchedule 1・2でproperty、pension、business interest、saving、debt、expected inheritanceをhonestly discloseしました。incomplete disclosure、pressure、fraud、material changeがあれば、courtが本agreementに与えるweightが変わり得ることを確認します。
## 4. record、reviewおよびcommunication
marriage中はhousehold cost用joint accountを維持し、willは各自作成できます。maintenance、pension sharing、housing need、child arrangement、courtが考慮すべきstatutory rightはwaiveしません。将来のchildはparental financial arrangementに拘束されません。
## 5. time limit、escalationおよびoutcome
各spouseはdraftを検討するため少なくとも28日を持ち、別々のsolicitorであるLucy GrantとOmar Shahからindependent legal adviceを受けました。duressなくvoluntarily署名し、5年後、major child・health change、substantial inheritance、business valueの大きな変動時にreviewします。
## 6. 留保および実務上のprotection
English courtがMatrimonial Causes Act 1973とfairness・needs principleを適用することを理解します。本agreementはsubstantial persuasive weightを意図しますが、outcomeをguaranteeせず、court jurisdictionを排除しません。safeguardingを損なわない範囲でdispute前のmediationを勧めます。
## 7. England and Walesのlawと署名
England and Wales lawを適用します。variationまたはrevocationには、fresh disclosureとadvice後の日付付きwritten agreementへの署名が必要です。RachelとMichaelは2029年7月1日に別々のwitnessの前で署名し、executed copyを保持し、will更新とtax adviceを勧められます。
