# PROPERTY FINDER AGREEMENT（PROPERTY FINDER AGREEMENT）

## 1. 目的と当事者
Sofia BennettはHomeward Search Partners Limitedを、£750,000のpurchase budget内でSurreyのfreehold three-bedroom homeをfindするfinderにappointします。finderはagreed postcodeをsearchしviewingをarrangeしoffer negotiationをassistしますが、conveyancing、survey、mortgage、regulated financial adviceはprovideしません。
## 2. 事実、範囲および条件
must-haveはtwo bathroom、usable garden、off-road parking、Sofiaのworkにcompatibleなcommuteです。125年未満のleasehold、known subsidence、Japanese knotweedはdeal-breakerです。Sofia自身がsearchをし、independent surveyとlegal adviceを得ます。
## 3. 手続と責任
appointmentは4か月exclusiveです。Homewardはmaterial conflict、referral payment、propertyへのinterestをdiscloseし、written search logをkeepし、value、planning permission、school catchment、conditionをguaranteeせずbalanced informationをgiveします。
## 4. 証拠、記録および保護措置
Sofiaはsign時にVATを含む£1,200 retainerをpayし、Homewardがintroduceしたpropertyのlegal completion時にVAT込み1.25% success feeへcreditします。purchaseなしならsuccess feeなしで、abortive feeはexpressly listedかつfairにexplainされた場合だけapplyします。
## 5. review、escalationおよびoutcome
HomewardはSofiaのidentificationとsearch preferenceをsecureにkeepし、authorised agentだけへshareし、offerをmarketする前にconsentを得ます。complaintはwritten procedureで行い、membershipがあればThe Property Ombudsmanまたはstated redress schemeへreferできます。
## 6. 留保と実務上の保護
Sofiaはmaterial breachまたはexclusive term後にterminateできます。Homewardはwritten termsがsupportするearned feeだけrecoverします。independentに購入したpropertyには、clearly defined introduction periodとcausation testを満たさない限りfeeはdueしません。
## 7. England and Walesの法と完了
England and Wales lawを適用します。8 October 2031にsignし、hand、post、emailを別個のpermitted notice methodとします。本appointmentはHomewardをSofiaのsolicitor、sellerのestate agent、transaction guarantorにはしません。
