# SCHOOL EXCLUSION APPEAL LETTER（学校除外APPEAL）

## 1. 目的と当事者
Daniel Hughesは、娘Ava Hughes（Northgate AcademyのYear 9 pupil）がanother pupilをthreatenしたとのallegation後、7 January 2031に15日間のfixed-period exclusionを受けたためappealします。Avaはthreatをdenyし、school decision待ちで欠席しています。
## 2. 事実、範囲および条件
appealは、headteacherが十分なevidenceを持っていたか、AvaのaccountとSEND profileをconsiderしたか、behaviour policyを一貫適用したか、期間がproportionateかをgoverning bodyがreviewするよう求めます。witness statementは重要な相違があり、alleged messageは添付されていません。
## 3. 手続と責任
meeting、representationのための合理的期間、written decisionとreason、supported returnを伴うreinstatementを求めます。schoolはexclusion中のworkをprovideし、allegationをprejudgeせずsafeguarding、education、welfare needをassessします。
## 4. 証拠、記録および保護措置
Avaのwritten account、other pupilのparentのemail、attendance record、SENCO adjustment planを提出します。schoolはoriginalをretainし、review decision-makerだけにcirculateし、可能な限りunrelated pupilをanonymiseします。
## 5. review、escalationおよびoutcome
governing bodyがreinstatementまたはcorrectionをしなければ、permanent exclusionならIndependent Review Panel（IRP）を求め、このfixed-period exclusionについてはavailable local authority/governing-body review routeを使います。IRPはstatutory circumstanceでuphold、reconsideration recommendation、またはreconsiderationをdirectできますがcriminal courtではありません。
## 6. 留保と実務上の保護
review中、Avaはalleged witnessにcontactしません。本appealはDanielまたはAvaのEquality Act 2010、safeguarding、education rightをwaiveせず、meetingにはreasonable adjustmentをします。
## 7. England and Walesの法と完了
本appealは9 January 2031付で、academy officeへのdeliveryとexclusions@northgate.exampleへのemailを別個の許可methodとして行います。statutory exclusion guidanceとEngland and Wales lawに従い、親としてDanielがsignします。
