# STATUTORY DEMAND LETTER（STATUTORY DEMAND）

## 1. 目的と当事者
Cedar Finance Limitedは、5 September 2029付signed personal loanに基づきdueした£18,750についてOliver Grantへstatutory demandをserveします。agreement、advance、payment history、interest calculation、debtがdueになったdateをidentifyします。
## 2. 事実、範囲および条件
creditorはdebtがpresently dueでgenuinely disputedでないとstateしますが、recovery officerへcontactしてproposalをするようinviteします。これはcasual reminderではなく、pay、secure、agree、resolveしなければinsolvency proceedingやlawful remedyをconsiderできるdemandです。
## 3. 手続と責任
prescribed formを使い、paymentまたはcontactのperiodとaddressをstateします。individualがset asideをapplyする場合、applicable Insolvency Rulesのtime limitとground（substantial dispute、counterclaim、service defect、other statutory reason）をcheckし、urgent adviceを得るべきと説明します。
## 4. 証拠、記録および保護措置
loan agreement、statement、default notice、service recordをencloseします。original demandとproof of serviceをpreserveし、paymentをpromptly creditし、accounting errorがあればcorrectします。personal financial informationはneed-to-knowのadviser、court、enforcement professionalだけにshareします。
## 5. review、escalationおよびoutcome
Oliverはfull sumをpayし、security・instalmentをproposeし、writtenでdisputeし、legal adviceを得られます。set-aside applicationはappropriate courtへ行い、disagreeだけでautomaticではありません。Cedarはwrittenでwithdrawまたはterm agreeできますがpetitionをしないとpromiseしません。
## 6. 留保と実務上の保護
demand自体はOliverをbankruptにせず、possession orderをcreateせず、enforcement agentのhome entryをauthoriseしません。defence、limitation argument、valid consumer-credit requirementをwaiveせず、ignoreやasset transferでcreditorをdefeatしてはいけません。
## 7. England and Walesの法と完了
England and Wales insolvency lawを適用します。10 June 2031付でOliverのlast notified addressへpersonal serviceし、postを別個のpermitted methodとしてcopy送付します。Cedar authorised officerがprescribed demandにsignしserviceをrecordします。
