# TUTORING AND PRIVATE TUITION AGREEMENT（PRIVATE TUITION契約）

## 1. 当事者と目的
14 Elm Road, Leicester LE2 5QFのindependent tutor Jane Smithは、Thomas Brown（2010年5月10日生）へGCSE Mathematics Higher（Edexcel 1MA1）とEnglish Language（AQA 8700）を提供します。parentであるSarah Brownがcontracting customerで、parental responsibilityを持ち、attendanceとcommunicationをsupportします。
## 2. 対象・対価・範囲
sessionは2029年9月5日開始、毎週火曜17:00–18:00、Zoomによるonlineで、10 session後にreviewします。Janeはlesson plan、marked practice work、reasonable feedbackを出しますが、gradeやexamination resultはguaranteeしません。feeは1 session 48ポンド、monthly in arrearsでinvoiceし、7日以内にBACSで払います。
## 3. 実施上の義務
Janeは2028年2月4日付Enhanced DBS certificateを保持し、Keeping Children Safe in Educationと整合するsafeguarding・child-protection practiceに従います。Sarahはonline tuitionにconsentし、contactableであり、Thomasにprivateだがobservableなlearning spaceを用意します。全relevant personのwritten consentなしにrecordやshareをしません。
## 4. 法令・記録・管理
Sarahは48時間前noticeならfree cancellation、24–48時間前なら50%、late cancellation・no-showはfull feeです。ただしillness等のexceptional circumstanceをevidenceできます。Janeはreasonableに可能ならrescheduleし、自身のcancellationはchargeしません。technical failureはrescheduleし、no-showとは扱いません。
## 5. 期間・終了・救済
original worksheetとteaching methodのownershipはJaneにあります。JaneはThomasにown learningのためuse、print、annotateするnon-exclusive licenceをgrantしますが、Sarahはpublish、sell、AI toolへのuploadをしません。Janeはtuitionに必要なcontact・progress dataのみprocessし、law・safeguardingがlonger retentionを求めない限り終了12か月後にroutine recordをdeleteします。
## 6. 責任と留保
各当事者は14日前noticeで終了でき、safeguarding concern、abusive conduct、repeated non-payment、unsafe online contactならimmediate endingが可能です。未使用のprepaid sessionはvalid deduction後pro rata refundします。Consumer Rights Act 2015のSarah・Thomasのrightをexcludeせず、Janeはreasonable skill and careに責任を持ちます。
## 7. 準拠法と署名
England and Wales lawを適用します。noticeは別記contactへのhand、post、emailで送れ、emailはdelivery記録時にeffectiveです。hand・post serviceにemail copyは不要です。Jane、Sarah、参加をacknowledgeするThomasが2029年7月15日に署名し、Sarahはaccessible copyを受領したと確認します。
