# SAMPLE LASTING POWER OF ATTORNEY
Date: 29 April 2029
Parties: Eleanor May Hart, Daniel James Hart and Priya Nair
## 1. Parties and purpose
Eleanor May Hart of 18 Harbour View Road, York YO10 2LD intends this instrument to be a lasting power of attorney for property and financial affairs under the Mental Capacity Act 2005. It is completed for England and Wales using the prescribed process.
## 2. Consideration and rights
Eleanor appoints Daniel James Hart of 42 Seabreeze Avenue, York YO10 2LE and Priya Nair of 6 Orchard Yard, York YO10 4LP to act jointly and severally, so either may make routine decisions unless Eleanor later restricts that authority.
## 3. Covenants and conditions
The attorneys may manage bank accounts, pay household costs, deal with benefits and tax, arrange repairs, and buy or sell investments in Eleanor's best interests. They must not make gifts except as permitted by law or the instrument.
## 4. Management and liability
Daniel and Priya must keep Eleanor's money separate, maintain accounts, avoid conflicts, consult her where practicable and follow her instructions while she has capacity. They must consider her will, preferences, welfare and least-restrictive options.
## 5. Term and remedies
The attorneys may act once the Office of the Public Guardian registers the instrument, subject to any restriction. Eleanor understands that registration does not remove her decision-making ability and that attorneys must support her participation.
## 6. Legal reservations
The certificate provider confirms that Eleanor understands the nature and effect, is not under undue pressure and has capacity when signing. Revocation, replacement and objections follow the Mental Capacity Act 2005 and OPG procedures.
## 7. Execution as a deed
Eleanor signs and dates the prescribed LPA pages before the required witnesses. This worked example does not replace the official form, registration, guidance or independent advice, and England and Wales law applies.
