# LIABILITY WAIVER AND RELEASE

Date: 18 June 2029

Parties: Peakside Climbing CIC and Sophie Turner

## 1. Parties and purpose

Peakside Climbing CIC of Unit 4, Avon Quarry, Bristol BS2 0SP allows Sophie Turner of 12 Hazel Walk, Bath BA2 7LU to take part in its supervised outdoor climbing session on 22 June 2029.

## 2. Money and rights

Sophie acknowledges inherent risks including falling, rockfall, weather, equipment failure, other participants and travel to the crag. She confirms she has disclosed a relevant medical condition, will follow the instructor's briefing and will not climb while impaired.

## 3. Duties and operation

Peakside will provide competent instructors, inspected helmets, harnesses and ropes, an emergency plan and a reasonable system for checking weather and route conditions. Sophie must use equipment as instructed and report damage, illness or unsafe conduct immediately.

## 4. Consent and management

Sophie releases Peakside and its volunteers from liability for loss or injury arising from ordinary inherent risks to the extent permitted by law, but not for death or personal injury caused by negligence, fraud, or breach that cannot lawfully be excluded.

## 5. Ending and remedies

Sophie consents to first aid and emergency contact with her named contact, Daniel Turner, if she cannot communicate. She remains responsible for her own travel arrangements and should maintain suitable personal accident and cancellation insurance.

## 6. Legal reservations

A parent or guardian must sign separately for any participant under 18; this document does not waive a child's rights or create a contract term that is unfair under the Consumer Rights Act 2015. Peakside may stop participation for safety or misconduct.

## 7. Signatures

The session fee is £65, refundable only under the published cancellation policy or if Peakside cancels. England and Wales law applies, and Sophie signs after having a reasonable opportunity to ask questions and obtain independent advice.
