# MEDICAL NEGLIGENCE PRE-ACTION LETTER

## 1. Purpose and parties
I, Lydia Morgan of 18 Fernbank Road, Leeds LS8 4QJ, write regarding the treatment provided by Westborough NHS Foundation Trust at Westborough General Hospital. On 14 September 2031 I underwent left wrist surgery, and I now ask the Trust to treat this as a Letter of Notification and Claim under the clinical negligence pre-action protocol, without asserting that liability has been established.
## 2. Facts, scope and terms
The concern is that a screw shown on the 22 September 2031 radiograph may have been placed in a position requiring revision surgery on 4 October 2031. I experienced persistent pain and reduced grip between the operations. The Trust may have a different account, and I rely on an independent orthopaedic opinion before drawing a final conclusion about breach or causation.
## 3. Process and responsibilities
I was absent from my employed work as a library assistant for 10 weeks, losing £4,200 net after statutory sick pay and receiving £1,100 in travel and prescription costs. I also paid £840 for assistance with shopping and cleaning, supported by receipts. The provisional special-damage total is £6,140; pain, suffering and amenity and any future loss are not yet valued.
## 4. Evidence, records and safeguards
Please preserve and disclose the relevant clinical records, consent and theatre documentation, imaging in its original form, implant details, nursing observations, incident reports and internal correspondence. I authorise the Trust to seek records needed to investigate, subject to lawful redaction. My general practitioner and rehabilitation records will be requested with appropriate authority rather than circulated unnecessarily.
## 5. Review, escalation and outcome
I propose that the Trust acknowledge this letter within 14 days and provide a detailed response within four months of receiving sufficient records and an independent report, as contemplated by the protocol. Please identify the NHS Resolution or other claims contact, confirm insurance and tell me promptly if any limitation issue is said to arise. I will cooperate with a reasonable records or examination request.
## 6. Reservations and practical protections
Pending investigation, I invite the Trust to discuss rehabilitation and the £6,140 documented expenses without treating that discussion as an admission. I will consider proportionate mediation or a joint expert process. Any settlement would need written terms, proper authority and advice about benefits and costs; I do not seek to pressure clinicians or obstruct continuing care.
