# PACKAGE HOLIDAY COMPENSATION CLAIM

## 1. Purpose and parties

Eleanor Hughes of 14 Willowbank Road, Cardiff, makes this claim against Suncrest Holidays Ltd concerning booking SH-48219, a package for Eleanor, Daniel Hughes and their daughter Lily at the Mar Azul Resort, Mallorca, from 3 June 2031 to 10 June 2031. The booking price was £2,880, paid in full on 12 February 2031, and the booking confirmation described a quiet family room, two outdoor pools and a half-board restaurant.

## 2. Facts, scope and terms

The east wing was being demolished from 7:30 to 18:00 on every day of the stay, although the booking documents did not disclose construction. The promised family room faced the works, contained a broken air-conditioning unit and was moved only on 6 June. The main pool was closed from 3 June to 7 June, and the children's pool was unavailable on 8 June; a smaller pool was overcrowded and not a reasonably equivalent facility.

## 3. Process and responsibilities

Eleanor reported the noise and room condition to Suncrest representative Marco Ruiz at 09:15 on 4 June and completed complaint form MA-1198 on 5 June. No alternative hotel was offered, and the promised room move did not occur until 6 June. On 6 June Eleanor developed vomiting, diarrhoea and fever after the buffet dinner; a resort doctor examined her at 11:40 on 7 June, prescribed rehydration treatment and recorded 36 hours of incapacity.

## 4. Evidence, records and safeguards

The enclosed evidence is the booking invoice, brochure pages 12 and 19, dated photographs of the demolition and pool notice, complaint form MA-1198, Marco Ruiz's email of 5 June, the doctor's report, and medical receipt MR-774 for £86. The family also spent £74 on sealed meals and £38 on a taxi to the clinic because the included buffet could not safely be used during the illness. These records identify what was reported in resort and what remained unresolved.

## 5. Review, escalation and outcome

Eleanor seeks a total of £1,248: £720 as a 25% reduction of the £2,880 package value for the seven materially affected days, £86 for medical treatment, £74 for replacement meals, £38 for the clinic taxi and £330 for the substantial loss of enjoyment and illness. The arithmetic is stated so Suncrest can check each head of loss; the claim is not a demand for the unaffected travel and flights to be refunded.

## 6. Reservations and practical protections

Suncrest is asked to acknowledge this letter by 2 July 2031 and pay £1,248, or give a reasoned settlement proposal with any undisputed sum, within 14 days of receipt. The request relies on the organiser's obligations under regulations 16 and 17 of the Package Travel and Linked Travel Arrangements Regulations 2018. Eleanor will reasonably mitigate loss, preserve the originals and provide consent for proportionate verification, but she does not accept a voucher as settlement without written agreement.

## 7. England and Wales law and completion

This completed fictional claim is dated 18 June 2031 and is governed by the law of England and Wales. If there is no substantive response by 2 July 2031, Eleanor reserves the right to use Suncrest's complaints process, any available ABTA or ADR route, and court proceedings, subject to applicable pre-action requirements and the three-year limitation period for personal injury claims under section 11 of the Limitation Act 1980. Nothing in this letter waives claims for further loss that could not reasonably be identified on 18 June 2031.
