# PRODUCT LIABILITY DISCLAIMER

Date: 6 February 2031

Parties: Merebrook Tools Limited and purchasers of the MT-18 cordless drill

## 1. Purpose and parties

Merebrook Tools Limited supplies the MT-18 cordless drill with this customer-facing notice. It describes foreseeable misuse, instructions and allocation of commercial risk; it is not intended to exclude liability that UK law does not permit a trader or manufacturer to exclude.

## 2. Facts, scope and terms

Use is limited to the manual's materials, voltage, battery and duty cycle. Users must fit the guard, inspect the bit, wear eye protection, keep children away and stop if the casing, battery or charger is damaged. Do not modify the safety interlock or use the drill in explosive atmospheres.

## 3. Process and responsibilities

Merebrook is not responsible for loss caused solely by deliberate alteration, failure to follow a clear safety warning or use outside the stated conditions, to the extent a court permits that allocation. The warning does not cover negligent design, manufacture, inspection, installation or unsafe instructions.

## 4. Evidence, records and safeguards

Nothing excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of the Consumer Rights Act 2015 implied terms, or liability under the Consumer Protection Act 1987 that cannot lawfully be excluded. Consumer remedies for faulty goods remain available.

## 5. Review, escalation and outcome

Business customers must report a suspected defect, preserve the product and permit a reasonable inspection. Merebrook will operate a recall and incident process, keep batch records and notify the Office for Product Safety and Standards where required. Consumers may contact the retailer for statutory remedies.

## 6. Reservations and practical protections

The notice is not a warranty replacement, does not make a consumer responsible for an unsafe product, and does not cap a loss where such a cap would be unfair or unreasonable. Any negotiated business limitation is separate, transparent and subject to reasonableness.

## 7. England and Wales law and completion

England and Wales law applies. The notice is supplied with the product and published at merebrook.example/safety on 6 February 2031. Daniel Foster, Compliance Director, approves it; mandatory statutory rights prevail.
