RESIDENTIAL TENANCY AGREEMENT

This Agreement is made between Seabird Property Holdings Pty Ltd and Alex Morgan and Jamie Patel for the residential property at Apartment 14, 62 Bay Street, Port Melbourne VIC 3207.

1. Term

The tenancy begins on 1 October 2026 and is fixed until 30 September 2027, subject to mandatory tenancy law.

2. Rent

Rent is AUD 650 per week, payable in advance on Monday to the managing agent's nominated account. Rent may only be increased in accordance with this Agreement and applicable law.

3. Deposit

The Tenant will pay a deposit of AUD 2,600. The Landlord must protect, hold and return it as required by law. Lawful deductions may be made for unpaid rent, damage beyond fair wear and tear, or other proven loss.

4. Permitted use

The Property may be occupied as a private residence by Alex Morgan and Jamie Patel. The Tenant must not cause nuisance, conduct unlawful activity, or sublet without any consent required under this Agreement or by law.

5. Utilities and outgoings

The Tenant is responsible for electricity, internet and lawful usage-based water charges. The Landlord is responsible for rates, owners-corporation charges and fixed water-service charges.

6. Repairs and condition

The Landlord must meet mandatory repair, safety and habitability duties. The Tenant must keep the Property reasonably clean, promptly report defects and not deliberately or negligently damage it.

7. Access

The Landlord may enter for inspection, repair or another lawful purpose after giving the notice required by law, except in an emergency.

8. Ending the tenancy

The tenancy may be ended only by lawful notice, agreement, court or tribunal order, or another process permitted by applicable law. Any contractual notice period is the period required by applicable law, subject to mandatory protections.

9. Governing law

This Agreement is governed by the residential tenancy law of Victoria, Australia. Mandatory terms and prescribed information form part of this tenancy whether or not repeated here.

10. Inventory, alterations and pets

The condition report and inventory signed at commencement form part of this sample Agreement. The Tenant must obtain written consent before structural alterations, painting or installing fixtures, but may make minor changes where local law permits. One domestic cat named Luna is approved, subject to lawful conditions and no unreasonable nuisance.

11. Insurance, damage and emergencies

The Landlord insures the building; the Tenant is responsible for insuring personal belongings. The Tenant must promptly report leaks, electrical hazards, loss of essential services and other urgent defects. Emergency repair rights and reimbursement are governed by mandatory tenancy law.

12. Quiet enjoyment and conduct

The Tenant is entitled to reasonable peace, comfort and privacy. The Landlord must not interfere except as permitted by law. The Tenant is responsible for the conduct of occupants and guests and must observe reasonable building rules supplied before signing.

13. Assignment, subletting and notices

Assignment or subletting requires any consent prescribed by law, which must not be unreasonably withheld where the law so provides. Formal notices must use the prescribed form and service method. Ordinary communications may be sent to the email addresses in Schedule 1.

Schedule 1 - Worked sample tenancy particulars

Landlord: Seabird Property Holdings Pty Ltd, care of Harbour Residential, 200 Queen Street, Melbourne VIC 3000.

Tenants: Alex Morgan and Jamie Patel.

Property: Apartment 14, 62 Bay Street, Port Melbourne VIC 3207, including car space 14B and storage cage 14.

Term: fixed term from 1 October 2026 to 30 September 2027.

Rent: AUD 650 per week, payable each Monday by electronic transfer.

Deposit or bond: AUD 2,600, to be lodged and administered as required by local law.

Included: refrigerator, dishwasher, washing machine, two building access fobs and one car-park remote.

Utilities: tenants pay electricity, internet and usage-based water charges where lawful; landlord pays owners-corporation charges, rates and fixed water-service charges.
