# SOCIAL CARE ASSESSMENT DECISION APPEAL

## 1. Addressee and requested review

To: Adult Social Care Review and Complaints Team, York Council. Subject: review of the 22 August 2038 care-plan decision. Please treat this as a request under your current review and complaints procedure and tell us which route and form apply; it is not an assumption that a particular appeal right exists.

## 2. Needs and chronology

Amina received 14 hours weekly from 1 February 2038 after an assessment of washing, dressing, safe transfers, shopping and meal preparation. On 22 August the council reduced this to 8 hours without identifying a change in those outcomes. Since 1 September she has missed meals twice and needed Leila's unplanned help with transfers.

## 3. Legal and procedural basis

Please reconsider the needs assessment and care plan consistently with the Care Act 2014 assessment and eligibility framework and current statutory guidance. Eligibility is needs-led rather than a diagnosis or budget label; we ask the council to identify the evidence and decision-maker's reasons, without asserting that Amina automatically qualifies for a particular package.

## 4. Evidence and interim safety

Enclosed are the 22 August decision, Amina's consent, her GP medication summary, an occupational-therapy note dated 30 August, a seven-day needs diary, and Leila's transfer log. Pending review, reinstate 14 hours or provide a safe interim plan, and confirm any financial assessment separately; Leila also asks how to request a carer's assessment.

## 5. Outcome and signature

Please acknowledge by 14 September 2038, arrange a senior reassessment or explain the current review stage, and give a written outcome by 7 October. Any judicial-review or other challenge has strict, changing rules and deadlines, so we will obtain advice and check the current route rather than treating this letter as proceedings.
