# TENANCY GUARANTOR DEED

Parties: Harbour Homes Limited, Tom Ellis and Grace Ellis
## 1. Purpose and parties
Grace Ellis gives this deed to Harbour Homes Limited to guarantee her son Tom Ellis's assured shorthold tenancy of Flat 3, 5 Brook Road, beginning 1 June 2031. The monthly rent is £1,200 and the tenancy, deposit and property address are identified in the schedule.
## 2. Facts, scope and terms
Grace guarantees Tom's rent and tenant obligations up to £14,400, being twelve months' rent, plus reasonable enforcement costs within that cap. The guarantee does not cover another tenant's separate liability, loss caused by Harbour's own breach or an unlimited indemnity. The parties intend the cap and scope to be clear.
## 3. Process and responsibilities
The deed lasts for the fixed term to 31 May 2032 and any statutory periodic tenancy only if Grace expressly agrees in writing. Harbour will give Grace copies of material rent-arrears and breach notices and a reasonable opportunity to ask Tom to remedy a default. Grace may pay an admitted arrear to prevent avoidable loss.
## 4. Evidence, records and safeguards
Grace confirms she received the tenancy and this deed in advance, had a real opportunity to obtain independent advice and understands that a deed is not simply a casual reference. She signs and delivers it as a deed in the presence of an independent adult witness. Harbour and Tom sign where required and retain executed copies.
## 5. Review, escalation and outcome
Harbour must not materially vary rent, term or tenant obligations and then claim the increased risk without Grace's written consent. A renewal, assignment, additional tenant or rent increase needs a new written agreement. Any release, waiver or compromise will state its effect; silence or accepting a payment does not silently extend the guarantee.
## 6. Reservations and practical protections
Grace may complain about an incorrect demand and may ask for account statements, but this deed is not legal advice or a promise that court proceedings will be avoided. Tom remains primarily liable and Harbour must comply with deposit, notice, licensing, equality and unlawful-eviction rules. The guarantor should seek urgent advice if liability is disputed.
## 7. England and Wales law and completion
England and Wales law applies. Grace executes this deed on 25 May 2031, with hand delivery, post and secure email to guarantors@harbourhomes.example as separate permitted notice methods. The parties record execution formalities, the £14,400 cap and the risk that an unagreed material variation may be unenforceable against Grace.
