# TUTORING AND PRIVATE TUITION AGREEMENT

Date: 15 July 2029

Parties: Jane Smith and Sarah Brown for Thomas Brown

## 1. Parties and purpose

Jane Smith of 14 Elm Road, Leicester LE2 5QF, an independent tutor, will provide Thomas Brown (born 10 May 2010) with GCSE Mathematics Higher (Edexcel 1MA1) and English Language (AQA 8700) tuition. Sarah Brown, Thomas's parent and contracting customer, confirms that she has parental responsibility and will support attendance and communication.

## 2. Scope, price and subject

Sessions are Tuesdays from 17:00 to 18:00 online by Zoom, starting 5 September 2029, with a review after ten sessions. Jane will provide lesson plans, marked practice work and reasonable feedback; she does not guarantee a grade or examination result. The fee is £48 per session, invoiced monthly in arrears and payable by BACS within seven days.

## 3. Operating duties

Jane holds an Enhanced DBS certificate dated 4 February 2028 and follows safeguarding and child-protection practice consistent with Keeping Children Safe in Education. Sarah must give consent for online tuition, remain contactable and ensure Thomas has a suitable private but observable learning space. Sessions must not be recorded or shared without written consent from all relevant people.

## 4. Compliance, records and controls

Sarah may cancel without charge with 48 hours' notice; cancellation 24–48 hours before costs 50%, and a late cancellation or no-show costs the full fee, unless illness or another exceptional circumstance is evidenced. Jane will rearrange a cancelled session where reasonably possible and will not charge for her own cancellation. A technical failure is rescheduled rather than treated as a no-show.

## 5. Term, ending and remedies

Jane owns her original worksheets and teaching methods. She grants Thomas a non-exclusive licence to use, print and annotate supplied material for his own learning, but Sarah must not publish, sell or upload it to an AI tool. Jane processes contact and progress information only to deliver tuition, keeps it secure and deletes routine records 12 months after the arrangement ends unless law or safeguarding requires longer retention.

## 6. Liability and reservations

Either party may end the arrangement on 14 days' notice; immediate ending is permitted for a safeguarding concern, abusive conduct, repeated non-payment or unsafe online contact. Unused prepaid sessions are refunded pro rata after valid deductions. Nothing excludes Sarah or Thomas's rights under the Consumer Rights Act 2015, and Jane remains responsible for reasonable skill and care.

## 7. Governing law and signatures

England and Wales law governs. Notices may be sent by hand, post or email to the separately stated contacts, with email effective when delivery is recorded; an email copy is not required for hand or posted service. Jane, Sarah and Thomas (to acknowledge participation) sign on 15 July 2029, and Sarah confirms an accessible copy was provided.
