WEBSITE TERMS AND CONDITIONS
Important notice
These fictional terms illustrate a small online service and are not legal advice or universally valid terms. The operator must tailor them to its countries of sale, product, payment model and users. Mandatory consumer, privacy, accessibility, advertising, taxation and electronic-commerce rules may override these provisions. Local law may require specific cancellation wording, disclosures, language, consent or business information, and a website should not rely on these terms without review.
1. Operator and scope
These terms apply to the website www.lumengarden.co.uk and the digital planning service operated by Lumen Garden Tools Limited, company number 15290418, registered office at 11 Quay View, Exeter EX2 4LN, United Kingdom. Lumen Garden provides garden-planning templates, planting calendars and optional design consultations. In these terms, Lumen Garden, we and us mean the operator, and you means a visitor or customer. By browsing, creating an account or clicking an acceptance button at checkout, you agree to the terms that apply to your use.
2. Accounts and eligibility
You must provide accurate information, keep your password confidential and promptly tell us about unauthorised account use. You are responsible for activity carried out through your account unless the loss resulted from our failure to take reasonable security measures. The service is intended for people aged 18 or over. A parent or guardian must not create an account for a child where doing so would breach applicable law. We may refuse registration or suspend an account for a reasonable security, fraud or legal-compliance reason and will explain where lawful.
3. Products, prices and orders
Prices are shown in pounds sterling and include value-added tax where the checkout says so. A product description is an invitation to order, not a promise that stock or availability will never change. An order is accepted only when we send an order confirmation. We may correct an obvious pricing or description error and offer a refund if you do not accept the corrected terms. Payments are processed by a third-party provider, and we do not receive full card credentials. You must not use another person's payment method without authority.
4. Digital service and consultations
After payment, a digital template is made available to the account or email address supplied. We may update templates for formatting, security or horticultural information, but an update will not remove material paid-for functionality without an appropriate remedy. Consultation appointments may be moved once with 48 hours' notice. We do not promise that a planting suggestion will succeed, be safe for every person or animal, or suit every climate, soil or planning restriction. You remain responsible for checking local conditions and obtaining professional advice where needed.
5. Subscriptions and cancellation
The seasonal library subscription costs £12.50 per month and renews monthly until cancelled. The checkout states the price, renewal interval and method of cancellation before payment. You may cancel through account settings or by emailing help@lumengarden.co.uk; cancellation normally takes effect at the end of the paid period. Where consumer law gives a cooling-off right for digital content, immediate access may require your express request and acknowledgement of the effect on that right. Nothing here limits a mandatory refund or cancellation right.
6. Acceptable use
You must not interfere with the website, probe its security, introduce malicious code, scrape the library, impersonate another person, infringe rights, submit unlawful or dangerous material, or use the service to provide professional advice while falsely presenting yourself as Lumen Garden. We may remove content and suspend access where reasonably necessary to protect users, the service or legal compliance. We will not use suspension to avoid a refund that the law requires.
7. Intellectual property and user material
Our software, branding, articles, illustrations and templates belong to Lumen Garden or its licensors. We grant you a personal, limited, non-transferable licence to use purchased materials for your household or one named project. You may print reasonable copies for that use but may not resell, publish, train a commercial model on, or distribute the materials. You retain rights in photographs or comments you submit and grant us a non-exclusive licence to host and display them to operate and promote the service. Do not upload material you lack permission to share.
8. Privacy and availability
Our privacy notice explains how we process personal information; it forms a separate document and may impose additional rights. We use reasonable technical and organisational measures, but no online service is completely secure. We may carry out maintenance and cannot promise uninterrupted availability. We will try to give notice of planned material downtime and restore service within a reasonable time.
9. Liability and complaints
Nothing excludes liability that cannot lawfully be excluded, including applicable consumer guarantees, fraud or death and personal injury caused by negligence. Subject to that limitation, we are not responsible for indirect loss or for garden outcomes caused by information you failed to verify against local conditions. Our total liability for a paid order is limited to the amount paid for that order during the preceding 12 months, unless mandatory law requires more. 10. Changes, law and contact
We may change these terms for legal, security or service reasons. We will post the revised version, identify its effective date and give notice where law requires. Continued use after the effective date may constitute acceptance only where legally permitted. These terms are governed by the law of England and Wales, but mandatory consumer protections in your place of residence continue to apply. The courts of England and Wales have non-exclusive jurisdiction where legally permitted.
