# EXAMPLE: WORKING TIME OPT-OUT AGREEMENT

Parties: Moorland Print Studio Limited and Oliver Grant
## 1. Parties and consideration
Moorland Print Studio Limited and Oliver Grant, Senior Press Operator, agree voluntarily that the 48-hour average weekly limit in the Working Time Regulations 1998 will not apply to Oliver from 1 April 2028.
## 2. Subject matter
Oliver expects an average of 52 hours for the seasonal poster contract, normally across four long shifts and one Saturday shift. The opt-out does not require any particular number of hours and does not waive rest, night-work or health-and-safety protections.
## 3. Operating terms
Moorland will publish the rota at least 14 days ahead, provide a 30-minute break on shifts over six hours and monitor fatigue through the weekly hours dashboard. Oliver may decline additional work where he is not fit to work safely.
## 4. Document mechanics
The manager must record actual start and finish times, on-call periods and rest breaks. Oliver checks the record weekly and reports an error to payroll; records are retained for two years as required for working-time compliance.
## 5. Party obligations
Occupational Health may recommend a reduced schedule, and the company will consider disability, pregnancy, medication, caring and travel constraints. No disciplinary action follows a good-faith refusal of unsafe hours.
## 6. Termination and survival
Oliver may withdraw this agreement by giving three months' written notice, or a shorter period if the company agrees. Withdrawal has no effect on hours already worked or accrued pay and must not be used as a reason for detriment.
## 7. Signatures
This agreement is reviewed on 30 September 2028 and ends on termination of employment unless replaced. It is governed by England and Wales law. Employer and employee signatures: ____________________.
