# Boundary Wall Maintenance Agreement
Date: 19 October 2026
Parties and reference: North property: 10 Example Close, Oxford, owned by Maya Ellis. South property: 12 Example Close, Oxford, owned by Daniel Reed. Correspondence at those addresses. Wall reference EXAMPLE-WALL-12.
## 1. Wall and limited purpose
The parties agree to repair the existing approximately 12-metre brick garden wall between their rear gardens, from the rear-house corner to the marked end pier, as recorded in their jointly signed photographs dated 12 October 2026. The works are local repointing and replacement of loose coping at the existing height and line, not rebuilding on a new boundary. This agreement neither determines ownership of the wall nor fixes, moves or transfers a legal boundary; any title dispute remains separate.
## 2. Statutory checks before work
Before appointment, a competent surveyor will confirm whether the proposed repair falls within the Party Wall etc. Act 1996 and what notices, consents or dispute-resolution steps are required. Neither this cost agreement nor informal neighbour approval substitutes for a required statutory notice or award. Any excavation, structural alteration, height change or extra work needs separate written approval and renewed legal checks. No work may start until those requirements and any planning or listed-building approvals are satisfied; if not ready, the timetable is postponed rather than presumed lawful.
## 3. Contractor and cost allocation
Subject to the checks, the parties jointly appoint Example Masonry Ltd under quote EXAMPLE-M24, fixed at £2,400 including VAT for the stated work and waste removal. Each owner contributes £1,200 directly against an itemised invoice after satisfactory completion, with no owner authorised to bind the other to variations. Extra costs require both signatures before commitment except separately agreed immediate safety action. The contractor must provide suitable public-liability cover and a written method statement; neither owner guarantees the contractor's performance to the other.
## 4. Access, damage and working times
Anticipated works are 9 to 11 November, 09:00 to 17:00 on weekdays only, with at least 48 hours' notice of actual access. Each owner permits the agreed contractor temporary garden access solely for these works, protecting planting and securing gates, without creating a permanent access right. No entry into either dwelling is permitted. Record condition beforehand, keep the route safe and make good damage caused by the works promptly at the responsible party's cost. A dangerous condition requires immediate warning and proportionate safety measures, not unilateral demolition.
## 5. Completion, disputes and signatures
Inspect jointly on completion, record defects and ask the contractor to rectify before final approval. For disagreement, exchange reasons and seek a joint independent surveyor or mediation; statutory Party Wall procedures, if applicable, remain available. This personal contractual allocation does not automatically bind future owners or create a registered land covenant. A sale should be disclosed and any future arrangement separately documented. English law applies and court remedies remain available without self-help entry. Signed on 19 October 2026: Maya Ellis and Daniel Reed, each as owner of the stated property.
