# Divorce Financial Consent Order — Covering Letter
Date: 14 September 2026
Parties and reference: Applicant: Hannah Mercer, 17 Willow Lane, Reading RG1 7PX. Respondent: Daniel Mercer, 6 Station Close, Reading RG2 8LT. To: the Financial Remedy Court dealing with case FM-EXAMPLE-260914.
## 1. Application and procedural position
Dear Court Officer, please place the enclosed agreed financial consent order before a judge for consideration. The conditional divorce order was made on 3 August 2026; the final divorce order has not been made. This letter summarises our agreement but is not itself an order and does not make the settlement binding. We understand that the judge must assess fairness and may request information or refuse approval.
## 2. Home sale and division
The former matrimonial home at 17 Willow Lane is to be marketed within 28 days of the financial order taking effect, under the detailed sale provisions in the draft. Using an illustrative sale price of £420,000, mortgage redemption of £180,000 and selling costs of £10,000, net proceeds would be £230,000: £138,000 to Hannah and £92,000 to Daniel. The operative term is 60%/40% of actual net proceeds, not those fixed figures. Mortgage obligations to the lender remain until redemption or the lender's express release.
## 3. Pensions, income and clean break
Each retains their own personal pension and bank accounts; no pension-sharing order, lump sum or spousal periodical payments are sought. We request the dismissals and clean-break provisions set out in the draft, subject to the court's approval and the stated implementation sequence. Our child Leo, aged 11, lives mainly with Hannah; child maintenance is dealt with separately through the Child Maintenance Service. We do not seek to oust that jurisdiction or describe child maintenance as extinguished by a spousal clean break.
## 4. Disclosure and enclosures
We exchanged full financial disclosure on 24 August 2026 and obtained independent legal advice. Enclosed are the signed agreed draft order, completed signed Form D81 statements, the required Form A application, the conditional order and the current court-fee payment confirmation. The D81 information records our assets, liabilities, pension valuations, incomes and proposed housing positions. No pension-sharing annex is enclosed because no pension share is requested. Please identify any further form, fee or evidence required through the applicable filing process.
## 5. Correspondence and confirmation
Please send any judicial query to both parties at their stated addresses and allow us to respond before any revised draft is approved. Each party bears their own legal costs under the draft; no contested costs order is sought. Neither party will treat this covering letter as authority to distribute sale proceeds or close the other's claims. Yours faithfully, Hannah Mercer and Daniel Mercer, both signing on 14 September 2026.
