# Holiday Let Management Agreement — Owner's Agency

Date: 19 October 2026

Parties and reference: Owner: Alice Grant, 8 Orchard Lane, York YO24 1PX. Manager: Fern Holiday Management Ltd, 12 Harbour Court, Whitby YO21 1PX. Property: Rose Cottage, 6 Example Lane, Whitby. Reference EXAMPLE-HLM-26.

## 1. Appointment and limited booking authority

The owner appoints the manager as disclosed agent, not tenant or purchaser, from 2 November 2026 to 1 November 2027. The cottage sleeps four; no parties, pets or stays exceeding 28 consecutive nights may be accepted without prior written approval. Booking contracts identify Alice Grant as accommodation provider and use the separately approved guest terms and cancellation policy. The manager may advertise within the agreed tariff of £90 to £160 nightly but may not promise services, grant exclusive possession on different terms or change cancellation rights without authority. Legal occupancy status depends on facts, not the holiday label alone.

## 2. Service scope and owner readiness

The manager handles listings, enquiries, arrival instructions, cleaning coordination, inspections between stays and a 24-hour emergency contact. Before accepting guests the owner must supply evidence of ownership authority, any mortgage or superior-landlord consent, appropriate holiday-let insurance, planning permission or lawful use and applicable registration requirements. The parties must complete and document fire-risk and other safety checks, gas checks where applicable, electrical safety and smoke/carbon-monoxide precautions as legally required. The manager must suspend unsafe bookings and notify the owner; allocating tasks does not remove either party's statutory duties.

## 3. Fees and worked monthly statement

The management fee is 15% of accommodation receipts actually collected after refunds, excluding refundable security deposits and separately charged cleaning, plus VAT if chargeable. The manager is assumed VAT-registered in this example. For £1,200 qualifying accommodation receipts, commission is £180 plus £36 VAT, total £216. An approved cleaner's separate invoice is £60 plus £12 VAT, total £72; the owner receives £912 after both deductions. No other platform, marketing or maintenance charge may be deducted unless disclosed and approved. The owner's accommodation VAT position is assessed separately, not determined by this fee example.

## 4. Money, repairs and guest information

Guest receipts and refundable deposits are held separately from the manager's operating money in its designated client account, reconciled monthly and never used for its expenses. This is not a claim of statutory deposit-scheme or insolvency protection. Itemised statements and cleared owner balances are sent by the tenth working day of the next month, with a reserve only for identified refunds agreed in writing. Routine repairs need approval above £150 including VAT; urgent work necessary to prevent injury or serious damage may be authorised up to £500 with immediate notice and evidence. Guest data are used only for necessary booking and legal purposes under documented data-protection roles.

## 5. Ending, handover and signatures

Either party may end on 60 calendar days' written notice to the addresses above. A material breach requires written detail and 14 days to remedy where capable of remedy; urgent safety suspension is separate. Existing bookings require an agreed lawful fulfilment or refund plan, not automatic cancellation or loss of guest rights. Within ten working days of ending, hand over keys, records, agreed account access and net client money, preserving required records securely. The manager answers for its own negligence and unauthorised acts; no exclusion covers death or personal injury caused by negligence. English law applies. Signed 19 October: Alice Grant; director Rowan Cole for Fern Holiday Management Ltd.
