# Nationality Decision — Judicial Review Pre-Action Letter
Date: 21 September 2026
Parties and reference: Proposed claimant: Meera Patel, 26 Rowan Road, Leicester LE2 3PX. Proposed defendant: Secretary of State for the Home Department, via the Home Office's published nationality judicial-review pre-action channel. Reference EXAMPLE-NAT-260902.
## 1. Open letter before claim and decisions
Dear Pre-Action Protocol Team, this is an open letter before claim under the Pre-Action Protocol for Judicial Review, not a private-law claim or a without-prejudice offer. I propose to challenge the refusal of my naturalisation application dated 2 September 2026 and the decision dated 14 September maintaining it after my 7 September reconsideration request. Please preserve the complete decision file. There is no removal direction, detention or other urgent interim application in this example.
## 2. Material facts and prior reconsideration
The refusal records 210 days outside the UK in the final 12-month period assessed, 1 September 2025 to 31 August 2026. My travel schedule, passport pages and carrier records show 80 days using the same counting basis. The refusal is based on the 210-day finding; it does not identify another refusal ground. My 7 September request supplied those records, but the 14 September reply repeated the figure without addressing them. I enclose both decisions, the reconsideration request and its evidence.
## 3. Proposed grounds and alternative remedies
The proposed grounds are a material mistake of fact and failure to consider relevant evidence when exercising the nationality decision-making power, with inadequate reasons for maintaining the disputed finding. I do not ask the court to substitute a grant of citizenship or assert that 80 days abroad establishes every naturalisation requirement. I have sought reconsideration and ask whether any further effective alternative remedy is said to be available, and why. I intend to take specialist advice on the proper court, grounds and procedural requirements before issue.
## 4. Remedy and information requested
Please withdraw the challenged refusal and reconsider the application lawfully on the corrected evidence, with a reasoned fresh decision. Please disclose the absence calculation, the source travel data, the relevant caseworker notes and the policy provisions actually applied, subject to lawful redactions. If any document is withheld, identify it and explain the basis. I am not requesting irrelevant personal data about other applicants.
## 5. Response, time limits and service
Please acknowledge receipt and provide the protocol response by 5 October 2026, 14 days after this letter, or promptly explain any proposed extension and reasons. I will consider a reasoned response and suitable alternative resolution. This correspondence and the reconsideration request do not stop time running: any judicial review must be brought promptly and within the applicable maximum period, normally three months from when the grounds first arose, with any shorter rule checked. I will not assume that reconsideration restarts time or wait for a reply if necessary to protect the issue deadline. Service of any proceedings must follow the applicable rules, not simply this letter's delivery method.
## 6. Contact and signature
Please reply to me at the stated address or through the secure correspondence channel recorded on my application, quoting EXAMPLE-NAT-260902. No other interested party has been identified; please say if your records indicate one who should receive this letter. I reserve my position on proceedings and costs without asserting that either is automatic. Yours faithfully, Meera Patel, signed 21 September 2026.
