# Section 42 Notice — Flat Lease Extension Claim

Date: 19 October 2026

Parties and reference: Tenant: Laura Bennett, Flat 8A, 24 Example Avenue, Bristol BS8 1PX. Competent landlord/freeholder: Oak Freehold Ltd, registered office 14 Bridge Court, Bristol BS1 4PX. Representative: solicitor Priya Shah, Example Lease Solicitors, 6 Garden Court, Bristol BS1 5PX. Reference EXAMPLE-S42-08A.

## 1. Formal claim and recipient

To Oak Freehold Ltd: I, Laura Bennett, give notice under section 42 of the Leasehold Reform, Housing and Urban Development Act 1993 claiming the right to acquire a new lease of the flat identified below. On the verified assumed title facts, you hold the immediate freehold reversion and are the competent landlord; there is no intermediate landlord or third party to the lease requiring an additional copy. This is a statutory claim, not an informal request for a discretionary extension or an acceptance of a landlord's proposed new lease.

## 2. Premises and existing lease particulars

The premises are the self-contained ground-floor Flat 8A at 24 Example Avenue, Bristol BS8 1PX, comprising the two-bedroom dwelling entered through its own front door and the rear patio demised by the existing lease; no garage, roof space or additional land is claimed. The lease is dated 1 January 1985, between Oak Freehold Ltd and Anne Lane, for 125 years from 1 January 1985, expiring 31 December 2109. Its illustrative title reference is EXAMPLE-LH-08A, not a real Land Registry number. Current annual ground rent is £200 under the existing terms.

## 3. Qualifying interest and premium proposed

I am the sole registered proprietor of the lease following the assignment completed on 3 August 2026. It is a qualifying long lease; the stated example assumes no statutory landlord or property exemption, no business tenancy and no earlier live or recently withdrawn claim barring this notice. I propose a premium of £18,500 for the new lease, based on the fictional valuer's 12 October assessment, and £0 for any other Schedule 13 amount. These are proposed figures, not a binding valuation determination or promise of the eventual price. No two-year ownership waiting period is asserted.

## 4. Terms proposed for the statutory lease

I propose the new lease required by Chapter II of Part I of the 1993 Act, for a term ending 90 years after the existing expiry, namely 31 December 2199, at a peppercorn rent throughout the new term, with the existing terms otherwise continuing subject to the Act's required modifications. No extra premises or voluntary premium ground rent is proposed. This example uses the operative flat-extension regime on 19 October 2026; an announced 990-year extension and wider valuation reforms are not assumed to have commenced merely because legislation authorises later changes.

## 5. Representative and counter-notice

Priya Shah of Example Lease Solicitors, 6 Garden Court, Bristol BS1 5PX, is appointed to act for me in this claim; that is the address in England and Wales for notices to my representative under this Chapter. You must respond by giving the section 45 counter-notice by 21 December 2026, a date not less than two calendar months after this notice is given on 19 October. Correspondence or negotiation does not by itself extend the specified deadline. Please direct requests for title evidence, inspection arrangements and any lawfully required deposit through my representative.

## 6. Signature and fictional service record

Signed by Laura Bennett, tenant, on 19 October 2026. Service record for this worked example: a complete signed notice was hand delivered at 10:00 on 19 October to Oak Freehold Ltd at its stated registered office, with delivery witnessed by Rowan Ellis and recorded in the solicitor's file. Email sent the same day is an information copy only and is not relied upon as statutory service. The representative must check actual title, eligibility, all recipients, service rules and later court or tribunal deadlines; this fictional record neither serves a real notice nor proves a real entitlement.
