# Limited Power of Attorney for Overseas Administrative Use

Date: 19 October 2026

Legal context: England and Wales - fictional worked example; overseas acceptance must be checked where relevant

Parties and reference: Donor: Alice Reed, 9 Example Grove, Bristol. Attorney: her brother Daniel Reed, 6 Example Court, Bristol. Property: fictional apartment 2A, 18 Calle Ejemplo, Cádiz, Spain; file EXAMPLE-CAD-2A, not an actual cadastral identifier.

## 1. Appointment and precisely limited authority

While I have the requisite capacity, I appoint Daniel Reed to request, collect and receive copies of the municipal property-tax statements for calendar years 2024 and 2025 relating only to the stated apartment, and to ask for clarification of entries. He may sign administrative requests needed for those copies, provide appropriately verified proof of my identity and receive written replies on my behalf. This is not a statutory general power in the Schedule 1 form and does not delegate every power I possess. Any receiving authority may require its own approved mandate or further evidence.

## 2. Excluded transactions and safeguards

The attorney cannot sell, buy, mortgage, lease or otherwise dispose of property; operate a bank account; pay or settle tax; admit liability; borrow; make gifts; alter a will; receive a refund; or appoint a substitute. He must not sign a land transfer, tax appeal, court document or settlement. Original identity documents must not be surrendered unnecessarily, and personal data may be used only for the stated enquiries. A request extending these powers must be referred back to me and, where appropriate, a qualified adviser, rather than inferred from a general phrase.

## 3. Duration, revocation and expenses

This ordinary power starts on delivery of this deed on 19 October 2026 and ends on completion of the enquiries or 31 March 2027, whichever is earlier. It also ends on my death or loss of capacity and may be revoked earlier by written notice; relevant recipients should be notified promptly and advised about reliance on earlier copies. It is not a lasting power of attorney and must not be relied upon after incapacity. The attorney acts without remuneration; I reimburse evidenced reasonable copying and delivery costs up to €250 in total, not an authority to incur other commitments.

## 4. Overseas acceptance, notarial and translation checks

English-law execution does not guarantee acceptance in Spain. Before use, a Spanish adviser and the receiving authority must confirm the required local wording, identification, notarial form, original or certified copy, translation and any apostille or other legalisation. A UK notary or solicitor and the FCDO Legalisation Office may be involved as applicable; no apostille, notarial certificate or sworn translation is created by this sample. Legalisation authenticates relevant signatures or seals, not the commercial adequacy or foreign legal effect of the powers. A destination-approved replacement may be needed.

## 5. Accountability and governing law

The attorney must keep copies of requests, replies and receipts, report material developments promptly and return documents securely on completion or revocation. I confirm lawful acts within these narrow powers only, not unauthorised acts. This instrument is governed by English law without displacing mandatory Spanish requirements for the receiving process. Any doubt about capacity, identity, scope or conflicting instructions requires the attorney to stop and obtain advice. The Spanish and Japanese versions are explanatory translations of this English-law scenario, not assertions that foreign formalities have been satisfied.

## 6. Execution as a deed and witness

Executed and delivered as a deed by Alice Reed on 19 October 2026, signed in the physical presence of independent adult witness Maya Cole, 14 Example Crescent, Bristol, teacher, who attests the signature. Donor signature: Alice Reed. Witness signature: Maya Cole. The witness is not the attorney or a party. Attorney Daniel Reed acknowledges the limits and accepts the appointment on the same date; his acceptance is not substituted for the donor's witnessed deed. All signatures and witness particulars here are fictional records; a downloaded file has not actually been executed, witnessed or notarised.
