# Statutory Noise Nuisance Complaint
Date: 12 October 2026
Parties and reference: Complainant: Emily Shaw, 18 Garden Street, Leeds LS6 2PX. To: Leeds City Council Environmental Health. Source: extractor at fictional Cedar Kitchen, 20 Garden Street.
## 1. Source and nature of disturbance
Dear Environmental Health Team, please investigate persistent noise and vibration from the commercial kitchen extractor next to my home. Since 21 September 2026 it has usually run between 18:00 and 01:00, producing a low-frequency hum and intermittent rattling audible in my bedroom with the windows closed. I believe the source is the external extractor serving Cedar Kitchen, but ask you to verify it rather than assume responsibility without inspection.
## 2. Diary and impact
My diary covers 22 September to 11 October. Examples are 24 September, 18:15 to 00:50; 1 October, 18:05 to 01:00; and 8 October, 18:20 to 00:45. On each night the noise repeatedly interrupted sleep and normal use of the bedroom. I attach the full diary and short recordings made from my own home. Phone readings are not presented as calibrated measurements or proof of a particular legal decibel threshold.
## 3. Prior contact and investigation requested
I raised the problem politely with the manager on 28 September and sent a written summary on 5 October. The manager said a contractor would inspect, but the disturbance continues. Please assess whether the circumstances amount to a statutory nuisance under the Environmental Protection Act 1990, including the frequency, duration, character and effect of the noise, and arrange appropriate observation or monitoring. This is not a request to treat all commercial noise as unlawful.
## 4. Remedies and practical access
If you are satisfied that a statutory nuisance exists or is likely to occur or recur, please take the abatement action required by section 80, subject to applicable procedures and any permitted delay for noise cases. I do not ask you to promise a finding before investigation. Possible practical measures include maintenance, vibration isolation or operating changes, to be assessed by competent officers. I can provide access to my bedroom by prior arrangement after 19:00. Please explain any out-of-hours reporting process and evidence format.
## 5. Confidentiality, records and reply
Please acknowledge this complaint, allocate a reference and give a contact and next steps. Keep my contact details restricted where possible, but explain if my identity or evidence must be disclosed for formal action; I understand anonymity cannot be guaranteed. I seek investigation and proportionate nuisance control, not an automatic compensation award or an immediate closure order. Yours faithfully, Emily Shaw, signed 12 October 2026.
